Goodyear tire class action news update:  The National Highway Traffic Safety Administration (NHTSA) says it has received reports that defective Goodyear motor home tires caused crashes that killed or injured 95 people over the past 20 years. The National Highway Traffic Safety Administration sent Goodyear a letter in March 2018, telling them that they are under investigation. NHTSA began investigating Goodyear’s G159 tires for safety issues last year after a court case where a judge told Goodyear data they had to give over records.
The Problem With the Tires
Some reports about the problem with the safety relate to the tire design. It is reported that the tires were meant for delivery trucks and not for recreational vehicles. Recreational vehicles can that travel at high speeds making the tires unsafe. If you have G159 Goodyear tires on your recreational vehicle or motor home, contact us about the investigation.
Secret Files Held by Goodyear
One of the big issues is that that Goodyear has kept the tire design and safety records, including injuries, a secret for year. They do this by having confidential settlements in those injury cases so no one can talk about it. Goodyear insisted the courts and judges ordered the documents sealed.
No Recall Yet
Even though there have been many many injuries and the records are a secret, the tires have not been recalled.
In a statement in March 2018, Goodyear said it received the letter “and will cooperate fully with NHTSA in its investigation, including providing requested information on its G159 tires.”
The Lawsuit
The nonprofit Center for Auto Safety and Public Justice asked to have the records released to the public. Goodyear has been fighting their request.
An Arizona judge ruled in favor of the center in March 2018 and unsealed most of the information. But the documents might be delayed again in an expected appeal from Goodyear.
The Judge in the lawsuit wrote that Goodyear’s need to keep information confidential “does not come close” to outweighing the public’s need for access.
“That information — primarily concerning the tire’s design, its testing, the decision to market it for use on motor homes, and the adjustment data generated by consumer experience with it — should be made public because it relates to and reveals a substantial potential risk to public health or safety,” he wrote.
